Vacation Benefits and Other Leaves

Yes, the vacation rules have changed.  Please see the MOA for full details.  Important - make sure you are not carrying over more vacation then the maximum 2 years worth.  Also note - As the City has stated several times, they will not take away anyone's vacation hours.  However, if you at the maximum allocation, you will stop earning new vacation hours!

Other Leaves - See the attachments to better understand these leaves. In general, your Union fought to ensure that these types of leaves would not impact your benefits. Meaning, you continue to accrue seniority, etc. when taking these type of leaves.

Family and Medical Leave Act (FMLA)

The Family and Medical Leave Act is a federal law which became effective on Aug. 5, 1993. It provides certain employees with up to 12 workweeks of unpaid, job-protected leave, a year and requires group health benefits be maintained during the leave. The U.S. Department of Labor (DOL) has issued detailed regulations interpreting the FMLA.

What happens to my health care benefits when I am on leave?  You may continue your coverage under the employer's group health plan. For example, if the employer pays 90 percent of your health care premium and you pay 10 percent, that same arrangement will continue during your FMLA period.

Every wonder why we don't pay into State Disability, and wonder how that effects us. Here is a chart that explains the differences. You will notice that San Jose has a 30-day waiting period. However, in the long run we have a better benefit that pays us 66.6% of our salary.

 


Long Term Disability Insurance


Long Term Disability Insurance (salary insurance) is not just for women.  Men need it also!  Things happen - you could have a major leg break, or get a debilitating illness - LTD Insurance will ensure you receive 2/3rds of your salary, tax free.  Tax free means it will be fairly close to your current paycheck amount.  So sign-up within the first 30 days of employment.  Link to City website.

The City now offers two forms of long term disability insurance.  One has a 30-day waiting period, while the second has a 60-day waiting period.  The 60-day waiting period version is less expensive, but you need to make sure you can hold out for 60-day before getting a paycheck.  The 60-day version is not recommended for women who are looking to use this insurance while on maternity leave.
